Long.
Division Direttar
RE: Letter of March 2, 1992, GEC Minerals, Inc., The GEC Strip Mine,
Permit No. C-81-037
On March 2, 1992 we received your letter regarding concerns with reclamation
of the West Pit. We would like to take this opportunity to respond.
You have correctly observed that Pond D in the West Pit is not designed for a
watershed of several hundred acres in extent. Exhibit 1 of the GEC permit
document indicates that the pond is designed for a 3.3-acre watershed.
Harrison-Western has never applied to the Division for a permit. The
reference in the surety that "Harrison-Western has applied for a permit
to conduct a mining operation" is present because. the document is a
standardized form used for all surety bonds.
A variance was never requested to delay contemporaneous reclamation for the
West Pit pursuant to 2.06.7.
Harrison-Western did not furnish a reclamation map nor a pond certification
for their application for Phase I bond release.
Harrison-Western does not have an exploration permit for a drilling program.
Harrison-Western posted a bond in the amount of $143,000 for disturbances in
the West Pit.
The West Pit is not considered an alluvial valley floor as defined in Rule
1.04(10) of the Colorado Coal Mining Regulations.
I hope this adequately responds to your inquiries
of further service.
Sincerely,
Daniel I.
