Long. <br />Division Direttar <br />RE: Letter of March 2, 1992, GEC Minerals, Inc., The GEC Strip Mine, <br />Permit No. C-81-037 <br />On March 2, 1992 we received your letter regarding concerns with reclamation <br />of the West Pit. We would like to take this opportunity to respond. <br />You have correctly observed that Pond D in the West Pit is not designed for a <br />watershed of several hundred acres in extent. Exhibit 1 of the GEC permit <br />document indicates that the pond is designed for a 3.3-acre watershed. <br />Harrison-Western has never applied to the Division for a permit. The <br />reference in the surety that "Harrison-Western has applied for a permit <br />to conduct a mining operation" is present because. the document is a <br />standardized form used for all surety bonds. <br />A variance was never requested to delay contemporaneous reclamation for the <br />West Pit pursuant to 2.06.7. <br />Harrison-Western did not furnish a reclamation map nor a pond certification <br />for their application for Phase I bond release. <br />Harrison-Western does not have an exploration permit for a drilling program. <br />Harrison-Western posted a bond in the amount of $143,000 for disturbances in <br />the West Pit. <br />The West Pit is not considered an alluvial valley floor as defined in Rule <br />1.04(10) of the Colorado Coal Mining Regulations. <br />I hope this adequately responds to your inquiries <br />of further service. <br />Sincerely, <br />Daniel I.
