Walther Executive Oveanr Michael8 Long Division Direaar Thank you for re-submittal of the May 18, 2001 letter to the Division regazding your questions for the Platte Sand & Gravel LLC, S & H Mine New 112 Application. The purpose of this letter is to respond to your questions and concerns you raised regarding DMG procedures. In regazds to Dr. Ptasnik's expert witness availability on May 23, 2001, this is no longer an issue since the item has been continued to the June 27-28, 2001 Mined Land Reclamation Board Heazing. In regazds to receiving a copy of the Pre-hearing Order, the Mined Land Reclamation Board ("MLRB") ordered a new Pre-hearing conference to be held prior to the June 27-28, 2001 Hearing. Once the new Pre-hearing draft order is finalized, it will be sent to all parties and interested persons. All questions regazding the Pre-hearing Order should be directed to the Board's attorney, Mark Heid at the Attorney General's Office. In your May 18, 2001 letter, you also requested a copy of the proposed permit terms and conditions drafted by the Staff. Only the Board can issue a decision on an application if objections have been received. A permit is issued once a decision for permit approval has been made (in this case by the MLRB) and the Applicant has submitted the required Performance Warranty and Financial Warranty to the approval of the Division. Once a Mining and Reclamation Permit is issued, all filings and commitments made by the Applicant become a binding part of the permit. This includes the Applicant's responses to adequacy issues raised by the Division. In the case of the S & H Mine, all correspondence and material provided by the Applicant reflect the approved mining and reclamation permit and plan. Only a technical revision or permit amendment can change the approved mining and reclamation plan. The permit file, including the permit application for the S&H Mine, is available for public review at the Weld County Clerk and Recorder's Office or at the Division of Minerals and Geology.
