The issues of traffic, <br />dust, and noise to which you refer are ones that are normally considered by the <br />county prior to the issuance or amendment of its permit. These are not issues that <br />are subject to the requirements of the Colorado Mined Land Reclamation Act and the <br />Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board under <br />which Summit Brick and Tile's present state reclamation permit was issued or any <br />future amendment of that permit would be approved. it is, therefore, your most <br />practical recourse at this time to make your comments on these issues to the county <br />Department of Planning and Zoning and to participate in any subsequent hearings <br />scheduled by the county in regard to its final decision. <br />As of this date, Summit Brick and Tile has not submitted any proposed amendment to <br />their existing state reclamation permit although I understand that ie their <br />intention in the fairly near future. Once that is submitted, advertisements will be <br />made in the local paper and a 20 day comment period will begin. As part of the <br />application process and in addition to the public advertisements, the operator will <br />be required to send notices to landowners within 200 feet of the land to be affected <br />by the operation as well as to any other owners of record who may be affected by the <br />operation. I will place your letter in the permit file the Division maintains for <br />public and staff use and will endeavor to have you notified when any amendment to <br />the existing Summit Brick and Tile state permit is submitted. Your comments and/or <br />objections, if received timely, will be considered by the Division in reaching its <br />decision. <br />If there are objections received to the proposed amendment to the state permit, the <br />decision will be made by the Mined Land Reclamation Board during a formal public <br />hearing. Any objectors are provided the opportunity during that hearing to address <br />the Hoard in regard to the decision. If you provide objections during the review <br />period for the amendment, you would be notified when the matter would be heard by <br />the Board. <br />I hope i have given you the information you are seeking.
