Box 704
Canon City, CO 81215
~~~
RE: Letter Dated July 7, 1993 Requesting Information
Dear Mr. and Mrs. Adams:
OF'~~(O
"~'b
~~i o
~~
r8]6 ~
Ray Ramer
Governor
M¢hael8 LOnR
Dwision Director
The notice you supplied with your letter pertains to an application for an amendment
to Summit Brick and Tile's county conditional use permit. The issues of traffic,
dust, and noise to which you refer are ones that are normally considered by the
county prior to the issuance or amendment of its permit. These are not issues that
are subject to the requirements of the Colorado Mined Land Reclamation Act and the
Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board under
which Summit Brick and Tile's present state reclamation permit was issued or any
future amendment of that permit would be approved. it is, therefore, your most
practical recourse at this time to make your comments on these issues to the county
Department of Planning and Zoning and to participate in any subsequent hearings
scheduled by the county in regard to its final decision.
As of this date, Summit Brick and Tile has not submitted any proposed amendment to
their existing state reclamation permit although I understand that ie their
intention in the fairly near future. Once that is submitted, advertisements will be
made in the local paper and a 20 day comment period will begin. As part of the
application process and in addition to the public advertisements, the operator will
be required to send notices to landowners within 200 feet of the land to be affected
by the operation as well as to any other owners of record who may be affected by the
operation. I will place your letter in the permit file the Division maintains for
public and staff use and will endeavor to have you notified when any amendment to
the existing Summit Brick and Tile state permit is submitted. Your comments and/or
objections, if received timely, will be considered by the Division in reaching its
decision.
If there are objections received to the proposed amendment to the state permit, the
decision will be made by the Mined Land Reclamation Board during a formal public
hearing. Any objectors are provided the opportunity during that hearing to address
the Hoard in regard to the decision. If you provide objections during the review
period for the amendment, you would be notified when the matter would be heard by
the Board.
I hope i have given you the information you are seeking. If you have other
questions, feel free to call.
Sincerely,
.la.wto~G 5~,~
James C. Stevens
Senior Reclamation Specialist
JCS/ern
M:\oss\ern\adams.wp
