PERMIT NO. M-77-342 <br />Dear Mr. Humphries: <br />1'he intent of this letter is to acknowledge the review of the Henderson Mine, Perniit No. M-77- <br />342, by the Office of Mined Land Reclamation under the Mineral Rules and Regulations of the <br />Colorado Mined Land Reclamation Board. Pursuant to Rule 7.2.3 of the Mineral Rules and <br />Regulations, we hereby concur with the Division that the Henderson Mine is a Designated <br />Mining Operation, although we do not entirely concur with the reasons cited in the Notice of <br />Determination as defined under CRS 34-32-103 (3.5). <br />Practices and procedures at the Henderson Mine have been established to protect human health, <br />property, and the environment. It is understood, however, that the Henderson Mine will be <br />required to develop an Environmental Protection Plan in accordance with Section 7.2 of the <br />above mentioned Colorado Minerals Program Rules and Regulations. We intend to comply with <br />the terms specified in the Regulations. <br />Due to the potential magnitude of the work involved, and by Rule 7.2.3(2)(c), we hereby request <br />a 180 day extension for submittal of the Environmental Protection Plan.
