Subject: ;~lotice of Violation Solid Waste Uistwsal Act Delta County, Colorado Gentlemen: e - Denver, CO. 80220 III III 1 IIIIII February 21, 1980 This letter is to inform you that the P]orth rr^ork solid waste disposal site under your jurisdiction is in viclation of minimmn standards contained in Colorado revised Statutes, 30-20-110, 1973, as amended and this Uepattment's reyulationa issued pursuant thereto. Copies of the must recent inspection rei,orte for Delta County are enclosed for your information. The t7orth Pork site is presently in noncompliance with regard to burning. There are steps available that may be taken in order to be authorized by permit to burn limited types of refuse. In counties with populations of 25,000 and less, County Commissioners may develop regulitiuns permitting noncommercial burning in unincorporated areas by designating areas which have no other reasonable alternatives, such as sanitary landfills or collection systems. The burning is to be limited to incineratiut~ in enclosed containers. ': he containers may range from approvable incinerators to 55 gallon drums. Burning will take place on a separate, designated site, and will not include rubber, tires, plastics, wire, insulation and other similar smoke- pcoduciny materials. In order to burn refuse, the County Commissioners must first develop regulations for this purpose. In this regard, we would like to review these before you adopt them by resolution. Second, a Particulate nnissions permit must be obtained from the Air Pollution Control Commission, and then a Certificate of Designation must be applied for according to Section 30-20-105 C.R.S., 1973, as amended. Upon receiving approval, restricted burning may take place at the site specifically designated in the permit. Since the above provisions have not been met, burning is not currently permitted on the present North Fock site.
