D.C. 20240 <br />~~B 61991 RECEIVED <br />FEB 1 1 1991 <br />Mr. Randy Corry <br />Chairman, Garfield Citizens' Alliance Mined Land <br />Box 111 Reclamation Division <br />Silt, Colorado 81652 <br />Dear Mr. Corry: <br />In my letter of October 29, 1990, I stated that I was deferring my decision under 30 <br />CFR 733.12(a)(2) to obtain additional information concerning your August 20, 1990, <br />request that I conduct an administrative evaluation and withdraw approval of parts of <br />the Colorado coal mining regulatory program and institute a Federal program for New <br />Castle Energy Corporation's (NCEC) Coal Ridge No. 1 Mine. <br />After carefully reviewing the information presented in and accompanying your original <br />letter, your letter of October 5, 1990, and other pertinent materials, I have decided not <br />to initiate action under 30 CFR Part 733 to partially withdraw program approval or to <br />institute a Federal program for the NCEC mine. My assessment of the issues which you <br />have raised in your request for an evaluation of the adequacy and implementation of the <br />Colorado State program are discussed in the enclosure. <br />If you should have any further questions, please do not hesitate to contact Mr. Robert H.. <br />Hagen, Director, Albuquerque Field Office, or myself. <br />Sincerely, <br />/S!
