MANAGEMENT <br />I am in receipt of a September 24, 2004, memorandum sent to Carl Johnston (OSM) from the U.S. Fish <br />and Wildlife Service which indicates Bowie Resources is not in compliance with the outcome of two <br />consultations pursuant to Section 7 of the Endangered Species Act. The formal consultations are: <br />ES/GJ-6-CO-96-F-11 <br />This consultation was for the depletion of 121.8 acre feet which required a payment of $1,588.27. A <br />minor additional depletion of 1.8 acre feet was identified which required a second payment of $24.14. <br />F W S/R6-ES/OSM-GJ-6-CO-99-F-034 <br />This consultation was for the depletion of 155.6 acre feet and required an initial payment of $2,234.42. <br />A minor additional depletion of 0.8 acre feet was identified which required a second payment of $12.54. <br />On behalf of Bowie Resources, LLC, I offer the following data to show that Bowie Resources did make <br />the required payments to the National Fish and Wildlife Foundation: <br />1. J. E. Stover & Associates letter dated November 6, 1996 which indicates that $1,588.27 was <br />paid to the National Fish and Wildlife Foundation by Bowie Resources Limited's check number <br />8389 dated October 9, 1996. <br />2. National Fish and Wildlife Foundation latter dated December 20, 1996 which acknowledges <br />receipt of payment of $24.14. <br />3. Copy of Bowie Resources hand written check register that shows a $2,234.42 payment was <br />made to the National Fish and Wildlife Foundation on December 20, 1999. <br />4. Copy of J. E. Stover & Associates cancelled $12.54 check to the National Fish and Wildlife <br />Foundation. <br />Please call if you have any questions. <br />Sincerely, <br />J. E.
