MLRD inspected the work on June <br />11 as documented in the coal inspection report of June 11. It was <br />pointed out that some items needed more attention, although the <br />majority of the required items were deemed to be adequate, including <br />the installation and location of the Diversion Ditch and Culvert. <br />The next inspection my MLRD took place on July 1, 1992, two weeks <br />after the completion of the required work. The report was primarily <br />directed at the revegetation aspect of the compliance agreement, <br />although the report pointed out some items which needed additional <br />work in order to complete the requirements. The most notable item <br />being the lower Rock Check Dam and its relationship to the Diversion <br />Ditch. In response to the concerns of the July 7, 1992 report HWC <br />arranged for the areas where the seed and straw had blown away to be <br />reseeded and additional mulch laid. There was also some hand work <br />completed on tite lower Rock Check Dam as it was not possible to get <br />any type of equipment into the side. This work took place during the <br />period of July 6-9. <br />The next inspection by MLRD took place on July 16, 1992 approximately <br />2 weeks after the last inspection. This report addresses the pond and <br />the Diversion Ditch, and primarily discusses the pond volume <br />requirements. For the first time, it was pointed out that the pond <br />must be of a size to accommodate 1.14 acre feet of water, which has <br />been determined by MLRD to be the appropriate size for a 10 year 24 <br />hour event. The determination was made a full month after the work <br />was completed by HWC and after the initial inspection was conducted <br />during the time of the initial work. The report also points out that <br />a primary spillway must be opened again. This is the first time this <br />requirement has been addressed.
