Dept Of fV3taril Res(i f_r <br /> Board of County Commissioners <br /> Eagle County <br /> 550 Broadway <br /> Eagle, Colorado 81631 <br /> Re: Nottingham Sand & Gravel Co. <br /> Special Use Permit Zs-42-77 <br /> Gentlemen: <br /> At the hearing scheduled for December 16 , 1982 , Nottingham <br /> Sand & Gravel Co. will seek the following changes in the <br /> terms and conditions of the above special use permit as <br /> originally granted by the Board of County Commissioners : <br /> 1. Formal waiver of the requirement of a separate <br /> bond to the County securing execution of the reclamation <br /> plan. We were under the mistaken impression that this had <br /> been resolved earlier but discover that no formal action was <br /> ever taken. The revegetation plan is identical to the one <br /> submitted to the Mined Land Reclamation Board ("MLRB") and <br /> has always been covered by a bond running to the MLRB. <br /> 2. Deletion of the requirement for a signal person at <br /> the railroad crossing. <br /> 3. Approval of an amended plat showing current <br /> locations of all facets of the mining operation. We also <br /> would like to have a formal understanding and agreement that <br /> a mining operation is by its very nature a progressive and <br /> fluid one. As the actual excavation of gravel moves from <br /> mined-out areas into unmined areas , as stockpiles of gravel <br /> are created and then sold , and as overburden is stockpiled <br /> and later reused, logic and efficiency dictate changes in <br /> the location of various items shown on the basic plat , <br /> though the essential pattern and nature of the operation <br /> remains unchanged. We submit that some flexibility must be <br /> allowed to the operator to make reasonable business decisions <br />
