Cattany <br />Division Director <br />Natural Resource Trustre <br />This letter is response to your letter dated November 27, 2006 regazding bonds and permits for <br />Basin Resources. A response to each of your two questions is provided below. <br />1. The Division of Reclamation, Mining and Safety has not received an application to <br />transfer the Basin Resources permit for the Golden Eagle Mine to another owner. <br />2. As stated above, an application for the transfer of the Golden Eagle Mine permit has not <br />been submitted. <br />The reclamation bond held by the Division for the Golden Eagle Mine is posted and maintained <br />pursuant to the bonding requirements of C.R.S. 34-33-113. We do not believe there is a <br />connection between the monetary judgment issued in your civil case and the remaining bond <br />held by the Division for the Golden Eagle Mine. <br />Rule 2.08.6 addresses the requirements for the transfer, assignment or sale of permit rights. If a <br />transfer application is submitted to the DRMS, the person applying for the transfer is required to <br />advertise the filing of the application in a newspaper of general circulation in the vicinity of the <br />mine. Any person whose interests may be adversely affected may submit written comments to <br />the DRMS, within 15 days of the newspaper notice. <br />Sincerely, <br />~' <br />Sandra L.
