Long <br />Division Director <br />On February 1, 1995, Bill York-Feirn and I met with you and John <br />Hickman to discuss the corrective actions included in our inspection <br />reports of 4-13-94 and 11-29-94. This is a summary of our <br />understanding of the agreements we reached. The Division understands <br />that neighboring land owners were contacted by flyer and met with the <br />operator. Please send a copy of the notification letter for our files. <br />1. Currently disturbed areas do not coincide with the approved mining <br />plan. Operator must submit a technical revision which reflects the <br />changes. This must be received by the Division no later than 4-10-95. <br />2. Neighbors were concerned with the safety of a recently excavated <br />dewatering trench in Phase H. Operator agreed to install a 6 foot <br />chain-link fence around the excavated area. Photographic verification <br />should be received by the Division no later than April 10, 1995. <br />3. The Division acknowledges that a monitoring program is now in place <br />which includes 6 monitoring wells being monitored on a quarterly basis. <br />Operator agreed to supply water to neighboring well owners, if needed, <br />due to impact to their wells. Please forward monitoring well details <br />including depth and current static water levels to the Division and <br />include copies of the monitoring reports to the Division as they are <br />completed. <br />If you have any questions, please contact me. <br />Sincerely, <br />Gary S.
