You recently asked what options were open to allow Grand Junction
Pipe and Supply to operate the Una Pit in Garfield county. There
are three options that could be followed to accomplish this.
rirst, a succession of opera~or (SO) request could be filed with
file Division of Minerals and Geology. The SO request would trove i.~
be accompanied by a replacement reclamation bond in the amount of
$188,168.00.
Second, a SO could be filed with an agreement that the present
bonding company change the name of the insured to whoever was going
to be the ^ew operator. Our conversations with the *Iew Hampshire
T_^~..rarcc Group (the company that has supplied the Curren}
Corporate Surety bond) indicate that they are not willing to change
the present bond in any way so this possibility may not be a real
option.
Third, the new operator could operate under the old permit with
written permission from CBW Builders. We would be required to
check whether CBW Builders is still a business entity that can
operate in the State cf Colorado and who could legall_; sigr. for CBS•:
Builders. A power of attorney document which proves that the
individual -pas the power to sign for the company would be required.
