Long Division Dueaor Houston, Texas 77074 RE: Response to telephone call of June 12, 1995 and letter dated May 18, 1995 concerning Golden Eagle Mine, Basin Resources, Inc., Permit #C-81-013 Dear Ms. Tatum: On June 12, 1995 you telephoned Susan McCannon to further inquire about the noise reduction structures referenced in section 4.04 of TR-15. This is the Technical Revision which addressed the NW-1 exhaust shaft. Several months ago when you telephoned me I do not remember discussing TR-15 with you. Rather, I recall that I directed you to Joe Dudash, as he was the Reclamation Specialist assigned the Golden Eagle mine at that time. I was the Reclamation Specialist who reviewed and approved TR-15 on November 28, 1990. The language regarding noise reduction structures is a part of TR-15. This language was not required by me, however, since the Division has no statutory or regulatory basis for such a requirement, I was aware that the exhaust shaft installation may generate noise and that there may be noise impacts to workers nearby. I therefore requested that the permittee include a provision for noise reduction structures. They agreed to this request and included the language. Inclusion of the language on the part of the permittee was discretionary, however, not compulsory. On August 9, 1990 I approved TR-14 which addressed the intake shaft installation. As you are aware, TR-14 does not include any language regarding noise reduction structures. You asked why I did not request noise reduction structures language in this earlier TR. I was not aware that noise levels associated with the intake shaft installation could potentially pose a problem, Moreover, as stated above, because the Division has no jurisdiction over noise levels, noise levels were not, and are not, under my purview.
