You were copied on our letter dated January 28,
2002 documenting our inspection initiated by Mr. Leef's written complaint.
One of Mr. Leef's concerns was apparent dust in the river north and east of the coal loadout.
During our inspection, we did not observe dust directly in the river. However, a sprinkling of
black dust was apparent on rocks next to the river and in the pasture grass adjacent to the
riparian area. It appears likely that this dust originates from the coal loadout, particularly during
the loading of the coal shuttle train. It should be noted that on this day, winds were very strong
out of the west and occasional strong gusts were noted, causing dust production from exposed
dirt surfaces unrelated from coal mining. The coal loadout did not appear to be a significant
source of dust but loading operations were not occurring either. The mine operator confirmed
that the most significant dust production from the loadout area occurred during shuttle train
loading. -
We would like your assistance in determining how to proceed regarding determining what level
of dust in this area is acceptable. Please contact me at your convenience.
Thank you for your time. I look forward to hearing from you.
Since ely,
D~
K Gorham
Environmental Protection Specialist II
CC: Elmer Bentley, Lorencito
Dan Hernandez, DMG
Ron Leef, landowner
