As you are aware, the OSM - WSC assisted the <br />Division in this investigation. <br />As a result of these further investigations the Division has issued <br />findings which indicate that it is likely that the water level in <br />the well was influenced by the adjacent underground workings and <br />exhaust shaft, but the water well is not permitted nor is the water <br />right adjudicated by the Colorado State Enginner's Office, and the <br />operator took measures to minimize hydrologic impacts in the area <br />of the well. Therefore we have concluded that no violation exists. <br />Attached is a copy of the letter transmitting our findings to Mrs. <br />Tatum. <br />I believe that these efforts further confirm that the Division has <br />responded to this TDN issue in an appropriate manner. Please <br />inform us of OSM's determination as to the appropriateness of <br />Colorado's action in this regard. <br />
