(303) 832-8106 <br />Mr. Berry: <br />Please be advised that we are filing our formal objection to Basin Resources, Inc. <br />and/or their successor, Westmoreland Coal Company's application for release of any <br />bonds of the Golden Eagle Mine and/or related operations. <br />Please make note that one area of concern is the "reclamation" of the ventilation <br />fan site on our property north of Highway 12, Weston, Colorado. This site in this present <br />condition is not acceptable to us as the landowners. The site in its present condition is a <br />danger to everyone in close proximity .and reduces the' value of our property <br />tremendously. Merely putting a cap on a big diameter shaft hundreds of feet deep <br />destroying the water strata is not reclamation or restoration. Long ago they were ordered <br />to re-grass the site and that has not been done. <br />Further, enclosed herein is a certified copy of the Findings of Fact in Cause <br />number O1CV26 that was rendered by the District Court of Las Animas County In <br />December, 2002 wherein the Plaintiff's Jim and Ann Tatum were awazded in excess of <br />Six hundred thousand dollars against the Defendants Basin Resources, Inc. This <br />judgment is abstracted and recorded so do not release any Basin/Westomoreland property <br />Please provide a copy of all written findings concerning all activity with reference <br />to the Bond Release with reference to the Golden Eagle and New Elk mines in Weston, <br />Colorado. <br />Please contact me at your earliest convenience to discuss this matter.
