MOUNTAIN COAL
-~° ~'COMPANVL.L.c.
A Subsidi:vy of Arch Weslcm Resources, LLC
RECEIVED
DEC 13 1999
December 8, 1999
Mr. Jim Burnell
Colorado Division of Minerals and Geology
1313 Sherman Street, Room 215
Denver, CO 80203
Division oI Minerals 8 Geology
RE: Raw Water Intake Gallery;. West F.Ik Mine; Permit No. C-80-007
Dear Jim:
iii iiiiiiiiiiiiiiii
999
West Elk Mine
P O Bax 591
5174 Highway 133
Somerset, CO 81434
(970)929-5015
Fax (970)929-5595
For your information, Mountain Coal Company (MCC) will be performing maintenance on the
infiltration lines of the Raw Water Intake Gallery (RWIG) located adjacent to the North Fork of
the Gunnison River per MCC's existing Nationwide 404 Permit. Due to low flows in the river
and sediment accumulation, MCC is not able to pump sufficient water for operation of the mine.
MCC plans to complete this work as soon as possible.
The work to be completed includes pushing sediment and debris off the buried intake lines and
rearranging rocks in the river, as MCC has done in previous yeazs. A track excavator will be
trammed over the berm near the RWIG to accomplish this work. The same path as in past years
will be utilized to access the river to minimize additional disturbance in the stream buffer zone.
Some fill material will be needed to allow access over the heat-taped, 12-inch raw water line.
MCC was issued a 404 permit by the Army Corps of Engineers permit in 1982 for the
construction of the RWIG. The maintenance or rehabilitation of a previously authorized and
currently serviceable structure or fill is allowed by the Corps under a Nationwide Permit (i.e. 33
CFR 330.~(a)(3)). No notification of the Corps is required under this Nationwide Permit.
Please call if you have any questions.
Sincerely,
'U
Christine E.
