Banta. <br />Drvis~on Director <br />DATE: February 7, 1992 <br />T0: Dan Hernandez <br />FROM: Joe Dudash <br />RE: Raton Creek, Permit No. C-82-055, Owner and other mining concerns <br />relating to John Adams. <br />At your request, I have examined the permit application of Energy Fuels Mining <br />Company for the Raton Creek Mine in order to answer two questions. First, is <br />John Adams listed as the owner of Raton Creek Mine, and second, does the <br />permit mention that John Adams also owns the Marr Mine (Kerr) and the <br />Southfield Mine? <br />First, the permit does not mention John Adams as the owner of .the Raton Creek <br />Mine. Page 2 shows that Raton Creek Associates, LTD., owns or leases all of <br />the coal rights, and that they authorized Energy Fuels Mining Company (EFMC) <br />to mine the coal. One page 3, John Adams is listed as the Chief Executive <br />Officer and one of the directors of EFMC. On page 4, Raton Creek Associates, <br />Inc., is listed as a business entity other than a sole proprietorship whose <br />general partner is Fisher's Peak Associates, LTD. But no owner's names are <br />mentioned for these businesses. <br />In the letter requesting the transfer of permit, dated April 30, 1987, found <br />in the file labeled "Request for Transfer Permit", John Adams is listed on <br />page 4 as the principal shareholder of the applicant (EFMC). On page 5 of the <br />same letter, it is stated that Raton Creek Associates, LTD., is "a Colorado <br />limited partnership whose sole general partner is Fisher's Peak Associates, <br />LTD., a Colorado limited partnership. The sole general partner of Fisher's <br />Peak Associates, LTD., is Energy Fuei Corporation." <br />As to the second question, page 5 of Raton Creek's permit application states <br />that Energy Fuel Mining Company holds no other surface coal mining and <br />reclamation permits. The application was submitted on April 6, 1987. <br />However, in the file labeled "Request for Transfer Permit", a letter was found <br />showing that MLRD had information that the Southfield Mine had received an NOV <br />on July 21, 1987. This letter, from the Colorado Water Quality Control <br />Agency, was received at MLRD on August 24, 1987. I found no information <br />concerning the Marr Mine (Kerr). <br />JD/sj <br />1241E <br />
