As we discussed, there is some question as to the
effective date of the notice and therefore the appeal deadline. You stated that the notice of the
final determination was published in a newspaper, but needed to check with your client on
t specifically which paper. In order to aid my and my clients' ability to participate in the MLRB
~./ programs, please confirm the paper in which official notices and agendas are published. Please
also confirm the date on which the SM-18 notice was published.
Also, please send any additional documentation from the files regarding these four mines. My
last request for documents regazding the DMO determination was addressed by DMG on March
10, 2006. As we discussed, the current request is for documents not previously provided and in
particular the records regazding DMG review and communications with Cotter regarding DMO
status. As we discussed, some of the requested records are expected to be filed today (April 17).
Due to deadlines involved, please send by e-mail attachment (preferred) or by fax in order that I
may review them in a timely manner.
Thank you again for your helpful assistance in this matter. If you have any questions, please do
not hesitate to call.
Sincerely,
s/Travis E.
