The inspection included a <br />records review. This review indicated that the permit that <br />CYCC is currently operating under at mine 1,2 and Eckman <br />Park is an interim program permit if 79-177. The permit was <br />issued by the Mined Land Reclamation Board on March 24, <br />1980 for a life-of-mine operation. <br />As you know the Colorado State program required all <br />operators of Surface coal mines operating on the date of <br />approval of the program and intending to operate after the <br />expiration of 8 months from the date of approval to file a <br />complete application for a permit no later than 2 months <br />following said program approval. Mr. Orell contacted Mr. <br />Dan Mathews, with your office, to determine the permit <br />status of CYCC. He was informed that a mine plan for CYCC <br />was apparently approved by the Office of Surface Mining <br />sometime in 1980 prior to approval of Colorado's permanent <br />program, but it appears that CYCC may not possess a permit <br />issued pursuant to the Colorado Surface Coal Mining <br />Reclamation Act and Section 506 of the Surface Mining <br />Control and Reclamation Act of 1977. <br />
