Long <br />Division Director <br />TO: Stipulation Tracking F~ West Elk Miae; File No. C-80-007 <br />FROM: Christine Johnston <br />RE: Revised status of stipulations <br />During the review period of Technical Revision No. 64, Mountain <br />Coal Company disputed the status of several stipulations. After <br />review of their comments and further research by the Division the <br />status of the following stipulations has been revised: <br />Stipulation No. 1 <br />Summary of stipulation: Cannot mine coal within Minnesota <br />Creek Basin until the Division has received a copy of an <br />adjudicated plan of augmentation. <br />The status is now complied with because MCC did submit this <br />plan in 1989. The question was whether the augmentation plan <br />still applies now that MCC will mine a different seam using <br />different mining methods. MCC states that they have received <br />a legal opinion stating the augmentation plan still applies. <br />Whether this is indeed true, the applicability of the plan <br />will be reviewed once the permit revision to expand into <br />Minnesota Creek is received. <br />Stipulation No. 2 <br />Summary of. stipulation: Submit an AHR with reports on inflow, <br />discharges and consumption of water within the mine. <br />Previously, the Division had stated that all of the <br />information except water consumption information was contained <br />within the permit. However, the mine consumption data is part <br />of the mine water balance included in each AHR. The status is <br />now terminated. <br />Stipulation No. 6 <br />Summary of stipulation: Limit extraction beneath the proposed <br />upper waste pile. <br />
