.. - • ,. iii iiiiiiiiiiiiiiii <br />PROPOSED DECISION <br />FOR <br />APPROVAL OF AN APPLICATION FOR RENEWAL OF PERMIT <br />BY <br />ENERGY FUELS MINING COMPANY <br />FOR <br />THE ANIMAS MINE (Permit C-82-055) , <br />Pursuant to C.R.S.34-33-109(7), the Colorado t4ined Land Reclamation Division <br />proposes to approve, with stipulations, the renewal of a permit to conduct <br />surface coal mining and reclamation operations by the Energy Fuels Mining <br />Company at the Animas Mine. <br />The decision is based on a review by the Division of the updated and complete <br />permit application and the existing permit, including all conditions and <br />revisions approved up to May 28, 1987. This review, as required by C.R.S. <br />34-33-109(7)(a), finds that the preponderance of evidence does not establish <br />the existence of any of the following conditions which would, otTierwise, be <br />reason for disapproval of the application for renewal of the permit: <br />1) The terms and conditions of the valid, existing permit are not <br />being satisfactorily met. <br />2) The present surface coal mining reclamation operation is not in <br />compliance with all requirements of the Act and the Rules <br />promulgated thereunder; <br />3) The renewal requested substantially jeopardizes the permittee's <br />continued responsibility on existing permit areas; <br />4) The operator has not provided evidence that the performance bond in <br />effect for the operation will continue in full force for the <br />proposed period of renewal as well as any additional bond required; <br />5) Any additional revised or updated information as required by the <br />Division has not been provided. <br />Accordingly, the permit currently held by Energy fuels Mining Company meets <br />the requirements for renewal, <br />The permit application will remain a binding part of the permit. Renewal of <br />the permit will be fora term of five (5) years from the date of expiration of <br />the previous permit, August 16, 19R7. <br />C <br />FR~iD R.
