Lamm <br />Governor <br />May 3, 1983 <br />Mr. Jeffrey Zingo <br />Office of Surface Mining <br />219 Central Avenue, NW <br />Albuquerque, New Mexico 87102 <br />Dear Mr. Zingo: <br />Re: Ten-Day Notice No. 83-2-6-2 <br />Issued to Colorado Westmoreland <br />Inc., Orchard Valley 14ine <br />Permit No. C-038-83 <br />This letter serves as the Division's initial response to the above referenced <br />OSM 10-day Notice. <br />As discussed with Thomas Ehmett by phone on May 2, 1983, the Division is <br />currently considering the DSM concern related to the failure to remove <br />sediment from Orchard Valley Mine Pond No. 3 and 4. An inspection of the <br />mine was conducted by me on April 27, 1983. Conditions at the mine were <br />essentially as mentioned in the 10-day Notice. However, no discharge was <br />occurring,therefore, no violation of effluent limits occurred at the ponds. <br />The operator has set up a pump and standby water truck to dewater the ponds <br />and prevent any discharge. The water was trucked to the "timber storage <br />area pond" which has sufficient excess capacity to handle this extra water. <br />Because of these circumstances, the Division proposes to hold-off on any <br />action until we have thoroughly evaluated the situation. In the meantime, <br />the operator is working to clean the ponds and prevent any environmental damage. <br />Our investigation is considering past inspection reports that may indicate the <br />history of this problem at the mine, the validity of the sediment storage <br />volume calculations approved by MLRD and OSM, and how similar circumstances <br />have been handled by MLRD at other mines. It will take a few more days to <br />look into these items. <br />The Division anticipates taking final action within the next week. I will <br />notify you of our action when a decision is reached. Ole would appreciate OSM <br />holding-off on taking any action until our investigation is complete.
