Banta lorado Mined Land Reclamation Division <br />RE: Coal Lease Application - C-44693 Western Fuels - Utah Inc. <br />DEA and MER report <br />archaeological resources. <br />Based on the Division staff's review of the Draft Environmental Assessment and <br />the Maximum Economic Recovery report their were no concerns identified that <br />would render the area unsuitable for leasing or permitting. In past leasing <br />and permitting actions the BLM has raised concerns in the areas of subsidence <br />in Red Wash harm to potential Hackfooted ferret habitat, and harm to <br />The State and BLM have reouired Western - Fuels Utah Inc. to undertake <br />mitigation measures which have been sufficient to meet all statutory <br />requirements. These will be applied to the new lease area as necessary and <br />included: a subsidence monitoring network along Red Wash to determine effects <br />of longwall subsidence (no material damage projected by BLM and MLRD); surveys <br />for potential ferret habitat, which in the past have not identified such <br />habitat; and surveys of lease areas for cultural and historic sites with <br />avoidance or evaluation stipulated as a precursor to disturbance. <br />If you have any further Questions, please feel free to call Tom Gillis, the <br />Reclamation Specialist responsible for this mine. <br />/sak <br />9289E <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203.2273 Tel.
