Permit No. <br />M-81-021, and Sunday Mine, Permit No. M-77-285, San Miguel County, from <br />Determination as Designated Mining Operations <br />Dear Mt. Humphries: <br />This letter follows previous correspondence and meetings concerning the Division of <br />Minerals and Geology review of the West Sunday and Sunday Mines relative Ito recently- <br />promulgated Hiles for Designated Mining Operations (DMO). As stated in our letters of <br />December 28, 1994, Energy Fuels Nucleaz, Inc. (EFN) believes that the West Sunday Mine and <br />Sunday Mine aze exempt from DMO rules. Section 34-32-10 8c 3 (3.5)(a) defines "Designated <br />Mining Operation" to mean a mining operation at which: <br />(I) Toxic or acidic chemicals used in extractive metallurgical processing are present <br />on site or; <br />(II) Acid- or toxic-forming materials will be exposed or disturbed as a resullt of mining <br />operations. <br />Subpart (b) refers to Section 34-32-112.5 for identification of types of designatted mining <br />operations, and concludes: "Such mining operations exclude operations which do not use toxic <br />or acidic chemicals in processing for purposes of extractive metallurgy and which will not cause <br />acid mine drainage." <br />9PafaJ93 b <br />
