~_, ,~ Permit No.#78-31 <br />MINED LAND RECLA.`tATION BOARL~ III IIIIIIIIIIIIIIII <br />Department of Natural Resources ~ 99s <br />1313 Sherman Street, Roam 723 Telephone: 839-3567 <br />Denver, Colorado 80203 <br />DE'~;ELOPn¢*PI AND E%TRACTION FfINING PER.`SIT <br />THIS PERMIT is issued this 1St day of February, 1980 by [he 2fined Land <br />Reclamation Board, Department of Natural Resources, State of Colorado. <br />W ITV E S S E T H <br />WHEREAS,U.S. Steel Corporation desires to conduct a(n) underground mining <br />operation, known as SOMERSET MINE for the purpose of extracting underground <br />mined Codl and <br />WHEREAS, on January 20 19 78,U.S. Steel COrpOratlOn "FILED" an <br />application,a reclamation plan and map, and the required fee, as required by Law; and <br />Sv1iEREAS, on AUgUSt 23 , 19 78, the ^tined Land <br />U.S. Steel Corporation application and set <br />WHEREAS, on January 18 19 80, the :tined Land <br />surety submitted by Federal Insurance Company and <br />date of issuance of the pewit and the anniversary dace <br />[dHERE_9S, the `Biped Land Reclamation Board has made <br />of issuing this pewit, that: <br />Reclamation Board approved <br />bond; and <br />Reclamation Board accepted <br />such date shall be considered the <br />far ali other purposes; and <br />a finding, fcr the purposes <br />1) the application complies with the requirements of the Colorado <br />'tined Land Reclamation Act and all applicable Loca'_, state and <br />Federal laws; and, <br />2) the operation will not adversely affect the stability of any <br />significant, valuable, and permanent mar.-made strut*_ures located <br />caithin two hundred feet of the affected land, except c:here there <br />is an agreement between the operator and the persons having an <br />interest in the structure that damage to the structure is co be <br />compensated for by the operator; and, <br />3) the proposed mining operations and reclamation can be carried out <br />in confornance with the requirements of C. ?_. 5. 1973, 34-31-116, as <br />amended (1976 Sess. Laws H.B. 1065); and <br />WHEREAS, for [he purposes of issuing this permit, the operator has made a <br />satisfactor;~ showing to the Board that he will employ during and after his <br />Underground Coal mining operations procedures reasonably designed co minimize <br />as much as practicable the disruption from the underground Coal mining operations <br />and will provide for the rehabilitation of the affected land through the rehabilitatior. <br />of plant cover, soil stability, water resources, and ether measures appropriate to the <br />subsequent beneficial use of such mined and reclaimed lands; and tha*_ is the event <br />of the failure of his proposed reclamation plan, he will take wha[evar meas~ires which <br />may be necessary in ordeF to assure the success of reclamation of the lands affected <br />by his underg"round Codl mining operations; and, <br />w?:EREAS, for the purposes of issuing this permit, a copy of the application <br />approved by the 'line3 Land Reclamation Board of the State of Colorado is attached <br />to this permit and thereby becomes a part of the terms hereof. <br />NOW, THEREFORE, pursuant to tae authority set =orth in the Co'_crado dined <br />Land Raclamation act, Article 32 of Title 34, C.Z.S. 19 i3, as amended, 1.1916 <br />=ess.
