We certainly do not think that we had given a <br />final approval to the reclamation work for Section 24, that the bid <br />document was the total work that would ever be done iii that area, nor <br />that there was no chance for any amendment to the bid document. <br />We believe that your statement that you would not clean up any noncoal <br />waste is not correct. In addition to the tire that GEC discarded, there <br />are many concrete foundations that GEC constructed and considerable <br />other noncoal waste such as oil drums that GEC left behind. <br />We reject your other statement that because there have been four lessees <br />on our property, you cannot prove who did what, and therefore, you will <br />do nothing. <br />While we do not believe that you can create a bid document that provides <br />for all contingencies without future amending or additions regardless of <br />what may be discovered during the reclamation construction, we will <br />expect your submission of another bid document with more detail and all <br />of the work to be done completely specified. <br />Sincerely, <br />~'© <br />W.D.
