M-1994-077 Natural Resource Tmstee
Washington County; Information Package
Dear Mr. Champ,
This letter and package are in response to our conversation of Mazch 16, 2006 during the DMG's
inspection of the Nickell Gravel Pit. On that day you requested additional procedural information
and an application package so that you may begin the process of applying to convert this site
from a 110 operation to a 112 operation.
Here are a few items to consider while completing this application:
• Follow the directions in the Construction Material Regulaz (112) Operation Reclamation Permit
Application Package.
• Pay special attention to:
o The notice and filing requirements
o Legal Right to Enter requirements
o Updates to maps
• Per our conversation on the date of this inspection, it may be in the operator's best interest to note (via map
and/or photo) current, historical, cut bank slopes and locatioDS for liability purposes.
• Due to the fact that this operation intersects with Vega Creek, a letter from the Army Corps of Engineers
will need to be obtained and forwarded to DMG stating that the proposed 112 operation will be in
compliance with their regulations, and/or outlining any stipulations.
• Depending upon the findings of the county when compiling its information for this conversion, it may be
unnecessary to resubmit the Hydrology, Wildlife, Soils, Vegetation, and Climate Exhibits (G, H, I, J and K
-See Section 6.4). This is onl y the case if existing conditions from the original 110 permit (enclosed)
match the current conditions exactly, If any deviation or variations occur they must be documented and
revised Exhibits must be submitted for this conversion.
• While DMG has taken the liberty of highlighting/tabbing items of significance to your specific application
within the Rules and Regulations and the Act, these items do not encompass all relevant information and
aze not intended to be the sole source of information. Please change any other information contained in the
conversion application in response to all sections of the enclosed Rules and Regulations and the Act.
If you have any questions, please do not hesitate to contact me at (303} 866-4179.
Sinc re ,
D E, tinim
Environmental Protection Specialist
Enclosures: Complete Set of Rules and Regulations for the Extraction of Construction Material
Original 110 Permit Application -including Supplement (7/28/1994), Adequacy Review (8/15/1994)
and Response (8/23/1994)
Constmction Material Regulaz (112) Operation Reclamation Permit Application Package
cc: Carl Mount; DMG (via a-mail)
Office of Office of Colorado
Mined land Reclamation Active and Inactive Mines Geological Survey
~--I,}fie: (,C/~1~C'-~+~ I~ COLORA`
EAFETY•ECIENCE
Bill Owens
Governor
rr DIVISION OF
d-G~ ~~Z M[NSRALS
GEOLOGY
RlC LAX ATION•NININO
