The Division will respond to your specific issues <br />in the order raised that correspondence. This response was prepazed in consultation with the <br />Office of the Attorney General. <br />"While closing down our project site 2004 we notice a seepage with a distinct discoloration of <br />the water from the area that Dirt-N-Iron buried several tons of iron and debris that was tell on <br />our property by previous mining companies. Originally the material was to be hauled off the <br />property, like much of it was, but we were told that there wasn't enough money left overfrom the <br />reclamation bond from the previous operators. <br />With our land contour 4% ro ti% slope, it will find it's way into Cache Creek since it was buried <br />approximately !00 yards above the creek oui of our ejj`ective area but still on our property." <br />According to the Division stafTer Jim McArdle, the Division conducted a permit revocation <br />reclamation project of the All Right Mining Permit, File No. M-1985-061, that was located on <br />the Van Ella property. The project was completed in Novemher 2002. The Division used the <br />entire bond amount of $4,400 to reclaim areas affected by All Right Mining Company under <br />pernLit M-1985-061. According to Mr, McArdle, all work was completed with the knowledge <br />and approval of the Van Ellas. The Van Ellas also participated in the pre-constntction walk <br />through with he and the silo contractor. Site work included hauling a lazge guantity of <br />miscellaneous trash and debris from the site, grading of steep highwalls, burial of a few lazge <br />pieces of steel fiom an abandoned powered shovel, and revegetation.
