The
first issue is to request further clarification of the Inspection Report
summarizing the inspection of the H-G mine on October 14-16, 1987. In
particular we would like further clarification of the results of the
topsoil survey. As we discussed, we feel that since the Division could
only drill to a depth of 24 inches, the statement that "the average depth
was 21.75 inches" would be based on a biased sampling technique. We
believe the Division's depth sampling results are not entirely
representative of the topsoil depths at the mine.
The second issue involves a commitment by the Division based on
this and past field surveys that the replaced topsoil depth meets the
requirements of the reclamation plan. This commitment would be in the
context of the necessary partial bond release requirements. Although we do
not request any specific topsoil related reduction in the bond at this
time, a determination by the Division that replaced topsoil depths are
adequate will hasten the release of the mine operator's obligations in this
issue.
