The Division has reviewed the concerns you expressed on behalf of Mr. <br />Scott. We are cognizant of Mr. Scott's ownership and believe Peabody Coal <br />Company has ensured that none of Mr. Scott's oil, gas, and other mineral <br />rights will be affected. <br />The proposed operation will not involve actual mining within Mr. Scott's <br />tract. If approved, this permit will not allow Peabody to conduct any coal <br />mining within the tract in question. This area is proposed for surface <br />disturbance only, for an approximately 200 foot wide haul road corridor. This <br />activity will not affect any mineral rights nor will it jeopardize any <br />possible oil and/or gas exploration and production within Sec. 16, TSN, R88W <br />of the 6th P.M..
