Box 591 <br />Somerset, CO 81434 <br />Re: Landslide Status and Mitigation -West Elk Mine - C-80-007 <br />Dear Ms. Johnston: <br />The Division has reviewed the materials submitted with your letter dated December 3, 1997. <br />Based upon the seriousness of the situation, as presented by Mountain Coal Company, we grant <br />your request to proceed with the mitigation work proposed with the December 3, 1997 letter. <br />If upon further review following our meeting scheduled for next week, or following future field <br />inspections, it becomes apparent that some type of permitting must occur, then such a directive <br />will be conveyed to Mountain Coal Company. Please ensure that ground operations aze <br />conducted in compliance with existing permit obligations. Be advised that the pumping and <br />discharge of ground water may require additional permitting from either the Water Quality <br />Control Division and/or the State Engineer's Office. Mountain Coal Company is encouraged to <br />communicate with those agencies to determine any regulatory requirements within their purview. <br />We look forward to our meeting scheduled for December 10, 1997.
