Box 591
Somerset, CO 81434
Re: Landslide Status and Mitigation -West Elk Mine - C-80-007
Dear Ms. Johnston:
The Division has reviewed the materials submitted with your letter dated December 3, 1997.
Based upon the seriousness of the situation, as presented by Mountain Coal Company, we grant
your request to proceed with the mitigation work proposed with the December 3, 1997 letter.
If upon further review following our meeting scheduled for next week, or following future field
inspections, it becomes apparent that some type of permitting must occur, then such a directive
will be conveyed to Mountain Coal Company. Please ensure that ground operations aze
conducted in compliance with existing permit obligations. Be advised that the pumping and
discharge of ground water may require additional permitting from either the Water Quality
Control Division and/or the State Engineer's Office. Mountain Coal Company is encouraged to
communicate with those agencies to determine any regulatory requirements within their purview.
We look forward to our meeting scheduled for December 10, 1997. Thank you for your
cooperation.
Environmental Protection Specialist
