Windermere <br />Littleton, CO 80102 <br />Mr. Kerr: <br />This letter is in response to your bond release inquiry concerning the Rimrock Mine, permit no. C-89-074. <br />We have reviewed the information submitted in conjunction with the Coal Mining Rules, which define the <br />requirements and process for bond release at coal mining sites. <br />Rule 3.03.1(4) requires a minimum bond of $10,000.00 to be held by the Division until bond for the entire <br />permit area is fully released. Therefore, we cannot reduce the required bond to $5,000.00. Also, any <br />reduction from the current amount of bond held by the Division must be done as specfied by Rule 3.03. <br />However, the Division generally agrees with your assessment of conditions at the site, as supported by our <br />past monthly inspections. We suggest that you consider applying for a Phase 11 bond release, which <br />would allow, if approved, further reduction in the required bond to be held by the Division. <br />The procedures for seeking a Phase II release are described by Rule 3.03. Many operators have chosen to <br />use SECAD+ modeling to demonstrate that the reclaimed area produces equal to, or less, sediment than <br />surrounding, undisturbed areas.
