Dcp!. of P.atuial Reso:uce~ <br />This will confirm our recent discussions concerning <br />the unexpected reduction in mining and related activities at <br />the Kerr Coal surface mine outside Walden. <br />As we discussed in our conference on Thursday, April <br />16, 1981, and as further explained in Kerr Coal Company's re- <br />cent letter to Governor Lamm, the sudden and unexpected termi- <br />nation of Kerr Coal's supply contract with its primary custo- <br />mer, Union Electric of St. Louis, Missouri, has compelled Kerr <br />to drastically curtail mining and related activities at the <br />Kerr mine. Kerr is concerned, of course, with maintaining its <br />present status of compliance with the Colorado Surface Coal <br />Mining Reclamation Act and we accordingly met with you to dis- <br />cuss what, if any, measures must be taken during this period of <br />greatly reduced mining activity. You indicated to us that you <br />and Mike Savage had quickly reviwed the recently issued Kerr <br />permit and it was your judgment that nothing in the way of <br />additional permit, permit amendment or technical revision <br />filings would be necessary to submit during this period of re- <br />duced activity. <br />
