CaRany <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology is in the process of doing a review of all operations <br />currently in temporary cessation. The file or Permit No. M 1980055HR for the Topaz Mine <br />operation indicates that it has been in temporary cessation since 10/26/1993. This exceeds the <br />statutorily allowed period of temporary cessation by 3 years. The Colorado Mined Land <br />Reclamation Act at Section 34-32-103(6)(a)(3) requires that all operators either reinitiate mining <br />operations or begin reclamation activities prior to reaching the end of the allowed temporary <br />cessation period. <br />Therefore, please provide the Division with written documentation, to include the date, that you <br />have reinitiated active mining operations as defined at Section 34-32-103(8) of the Colorado <br />Mined Land Reclamation Act, or have begun site reclamation as defined at Section 34-32- <br />103(13). <br />If you have any questions, please contact the Division at (303) 866-3567 and ask to speak to the <br />Environmental Protection Senior Specialist responsible for your area of the State.
