Box 897 <br />Oak Creek, Colorado 80467 <br />Re: Fish Creek Tipple Mid-Term Permit Review - File No. C-81-036 <br />Enclosed is the Division's Mid-term Review and Decision to require revisions <br />to the Fish Creek Tipple, Permit No. C-81-036, <br />Rule 2,08.3 of the Regulations promulgated pursuant to the Colorado Surface <br />Coal Mining Reclamation Act (C,R.S. 34-33-101 et seq.) requires the Mined Land <br />Reclamation Division to conduct a mid-term permlt review. A review of <br />outstanding permits is to be conducted and, for good cause shown, reasonable <br />revisions or modifications of the permit provisions during the term of <br />such permit may be required, Such revisions or modifications shall he based <br />upon written findings and shall be subject to the notice and hearings <br />requirements of the Act. Additionally, Rule 3,02.2(4) requires that the bond <br />be reevaluated. The Division will calculate the bond following receipt of <br />responses in Section III B. <br />The mid-term review raises three issues. One, the Division requests that <br />Pond E be re-designed to handle spoils spring flow and operation discharge, as <br />well as the 10 year-24 hour event. Two, Twentymile Coal Company needs to <br />re-evaluate the use of spoil material as a plant growth medium. The textural <br />analysis found in the permit application characterizes the material as unfit <br />for re-establishment of pastureland, Third, the Division requests a more <br />detailed description of the reclamation plan, This will permit the staff to <br />evaluate approximate original contour criteria and to calculate a more <br />appropriate bond value. <br />Please prepare a packet responding to the mid-term by December 14, 19 7.
