E«nhe,d <br />Eaeculive Director <br />Michael B. long <br />Division Dirmor <br />Re: Marking Mining and Reclamation Permit Boundaries <br />Dear Mr. Carmen: <br />On a recent monitoring inspection of some of Mesa County's Limited Impact Permit (110) gravel <br />mining operations, it became evident that it will be very difficult for Mesa County to comply <br />with the new Minerals Rule 3.1.12 requiring that "the boundaries of the affected area will be <br />marked by monuments or other markers that are clearly visible and adequate to delineate such <br />boundaries." Also, you could be considered to be in violation of many if not all of your permits, <br />since equipment operates outside of and between .the boundaries of separated affected Lmd <br />(permit) boundaries. These disturbances could be considered offsite damage and subject to <br />enforcement under the Mined Land Reclamation Act, Section 3432-116(Tj(h). <br />A number of Mesa County's l10 mining and reclamation permits have mine plan maps showing <br />the boundaries of affected areas to be in several separate parts and irregular in shape. This type <br />of affected lands boundary would be very difficult to mark. To make the task of marking the <br />boundaries easier for Mesa County and monitoring inspections easier for the Division, we will <br />allow you to change your permit boundaries. This can be done with a Technical Revision of the <br />permit (no fee for 110 permits). <br />If you decide to submit such revisions, you must provide, in writing, a statement of the <br />Lmdowner's approval. of the proposed change. You must also notice the public as if a new <br />permit were being applied for. If there are objections to the revision, the Division would then <br />handle the application as if it were for a new permit, and the appropriate fees would then be <br />required. Mesa County would have the option of withdrawing the application at any point before <br />final approval. <br />A straightening of the otherwise irregular permit boundaries can be accomplished through a <br />Technical Revision using one of two methods. The preferred method would be to drew a closed, <br />multiple straight-sided boundary, such as a triangle, rectangle, square or polygon close to but <br />around all of the present affected land boundaries. The other method would be to draw a new <br />
