MONTRC~~, ~v u 1~ I'Y
LAND USE DEPARTMENT
P.O.Hox 1289
Montrose, Colorado 81902
Phone 2498888
Attn: Ed Bischoff, Mineral Supervisor
Mined Land Reclamation Division
Department of Natural Resources
423 Centennial Building
1313 Sherman Street
Denver, Co. 80203
Dear Mr. Bischoff:

fg 2C ~g87
~~c M~n,Ea ~a
~'`"''AT,oN avs,oN
I
~~~~ ~~®
F
I have a question which I discussed briefly with Mark I~oye
concerning an MLR permit which Montrose County holds, and Mark
suggested I submit the question to you f view.
Montrose County holds an MLR Permi #77-407 (a which was
amended, I believe, in 1984). The subje ravel it was
initially leased from Kenneth Lane. In the recent past our lease
expired and before renewal, the property was acquired by the
Federal Land Bank Association through foreclosure. Since then,
the Federal Land Bank sold the ranch to a Mr. Gordon Auetry.
During the last several months the Colorado Highway Department
has let a contract for state highway reconstruction in the area
of the subject gravel pit. For this project the State Highway
Department has contracted with United Paving Company of
Grand Junction.
Our question is this - If we prepare and submit an Affi+9avit
of Agreement signed by a State Highway official, Mr. Auetry
(the land owner}, a United Paving Company representative, and the
Montrose County Commissioners, can extraction of gravel under our
Reclamation Permit take place for this project? And can it hike
place without jeopardizing our permit? The estimated needs i°or
this project would be 50,000 tons.
Thank you for your consideration in this matter. If we could
obtain your decision on this question within two to three weEks
it would be very helpful.
Sincerely,
Patrick T. Warren
County Planner
- .
February 24, 1987
PTW/ms
CC: Montrose County Commissioners
