As you know, the entire pex~ilting situation snrroundinp, the McClane Canyon site ' has been quite confusibg over the peat year due to the chanp.,ine, federal requriements. Sherida$ has made at least two submittals to this office. The most recent of thei)n submittals was received on .Tuly ZO aid was sthedulad for consideration at 'E~,e'October 24-25, 1979 Beard Heating. Upon receipt of the document, nn a pt was made by this office to coordinate the review with the Office of 8u a Mining. At that time, no concerted effort was being made by OS*t to ra~gw.the document. Since the mine was continuing to operate and the delay was principally at the federal level, we made a de- cision to place review a Che Sheridan application at a lower priority than several other pending appcations for new operations. By the end of Sep- tember it was clear that,t~M had still not initiated their review and a decision was made to prei~`forward on an independent state review. .x~ s The McClane Canyon applica~vn to currently being reviewed under the existing state regulations and the`-'~grmanent federal regulations. That review, while not yet complete, has id~nt~fied several pnesible deficiencies with respect to the permanent regulatory program. You will be notified inwriting of all deficiencies when the review is complete. However, in light of the incom- plete review, the possible deficiencies, and the delays at the federal level, we do not feel that it would be appropriate for the Board to consider the application at the Octob~e meeting. Under these circumstances it is probably in your Sheridan's interest to request the Board to defer their consideratlon of the application. In the meantime Sheridan may continue operatin as speci- fied in their approved notice of intent and inccompliance with all applicable performance standards.
