BoM 1821 ~ ~ ([f/~/_ ~/ ~ <br />COLORADO SPRINGS, GOLD RADO 80901 v ~~ • ~ ~~ <br />Apr. 10, 1992 <br />Mined Land Reclamation Board <br />1313 Sherman St. <br />Denver, CO 80203 <br /> <br />wnnL;,, ~antl <br />Dear Mined Land Reclamation Board: <br />As requested by the Board at the March meeting, we have attempted to give you <br />this brief summary of the important points regarding the responsibilities of <br />the Harrison 4!e stern Corp. in the GEC West Pit. <br />In 1982 Harrison Western Corp. posted the reclamation bond for the West Pit <br />for GEC. Harrison Western's stated purpose was to evaluate the GEC strip pit <br />as a means to enter Harrison Western's underground coal reserves. <br />In 1987 Harrison Western committed to performing the required reclamation of <br />the West Pit in lieu of bond forfeiture. Harrison Y?estern has only performed <br />two small reclamation maintenances in 1989 and 1990. The Division did not do <br />periodic routine inspections of the West Pit from 1987 until 1991, and there <br />are several serious violations of the performance standards. <br />Harrison Western's intent was as an operator in their evaluation of the West <br />Pit as a mining entry and in their drilling of at least one drill hole without <br />a permit and without a variance fur contemporaneous reclamation. In 1985, <br />Harrison Western stated that they were the operator in their request for phase <br />I bond release. The Stockpile Ik2, which was the overburden pile resulting <br />from the excavation of the West Pit, is clearly part of the Harrison Western <br />bond by its inclusion in the legal description of the bond. We believe these <br />are the only questions that need to be resolved by the Board: whether Harrison <br />Western is the operator and whether the Stockpile Ik2 is part of the West Pit <br />bond. <br />Harrison Western must comply with the Rules and Regulations with regard to the <br />performance standards and bring the Sdest Pit reclamation into compliance. <br />Eight months have elapsed since the Division's inspection noted many <br />violations of which several are serious. We do not believe that Harrison <br />Western has the option to negotiate their compliance with the Rules and <br />Regulations. <br />Sincerely, <br />W~~~ <br />W.D. Corley, <br />President <br />
