Lun{ <br />Dinsion Director <br />The Division appreciates your letter stating your concerns about dust, the sewer system, and the <br />CC Company ditch. Many of these concerns were brought to the attention of the Peabody Coal <br />Company in 1988, and a town meeting was held to discuss these items when Peabody proposed to <br />mine the coal reserves just east of Nucla. Since that time, Peabody has sold their rights to mine <br />the coal to Western Fuels of Colorado. <br />Since Western Fuels has assumed the right to mine the coal east of town (the site is now called the <br />New Horizon Minel, they have held town meetings to discuss numerous concerns of the <br />community of Nucla. As prescribed by law, Western Fuels has conducted an extensive pre-blast <br />survey of all houses and facilities within one-half mile of the permitted boundary of the mine. The <br />Division has these reports as well as the new mine permit that was submitted on November 24, <br />1992. <br />The Division will commence the review of this new permit in approximately two weeks and will <br />publish a notice in the local newspapers which will initiate a 90-day public comment period. During <br />this time, a copy of Western Fuels' mining permit will be at the courthouse for review. I strongly <br />urge you to review the permit to see if their methods of mining and control measures will alleviate <br />your concerns. In any event, I have enclosed a portion of the new permit pertaining to air <br />pollution.
