O'BRIAN <br />PRESIDENT <br />February 14, 1994 <br />Colorado Mined Land Reclamation Board <br />1313 Sherman Street, Suite 215 <br />Denver, CO 80215 <br />Ladies and Gentlemen: <br />RE: Delta Sand and Gravel Co. <br />Pit # 1, M-77-020 and <br />Pit # 3, M-77-022 <br />7985 VANCE DRIVE, SUITE 205A <br />ARVADA, COLORADO 80003 <br />303.423-7297 <br /> <br />FEB z 5 1894 <br /> <br />It has come to my attention that there is a discussion taking <br />place between the Division of Minerals and Geolo~fy staff and the <br />Gelta Sarrd and Gravel Co. concerning the approval of these permits. <br />In particular, the problems seems to be whether the processing <br />areas near~Pit #3 in`Paiona anci the processing site in Delta (Delta <br />plants were'in use prior to and for the sole purpose of processing <br />material from all the Delta pits in the market area. <br />I was the consultant that prepared the applications and <br />represented Delta Sand and Gravel in March, 1977 when they came <br />before the MLRB. I do not recall if this was specifically <br />discussed at that time, but know that we stated in both permit <br />applications that materials mined from these pits would be <br />processed offsite. There were three pits operated by Delta Sand <br />an3 Gravel when the Lat•~ went into affect and the Delta Plant and <br />the Paiona site existed prior to the law also. <br />The fact that processing has always taken place off the mine <br />sites was reconfirmed for Pit #1 on page 7 of the 1980 Conversion <br />application that should be in your files. While the exact location <br />of the processing site was not spelled out in the applications, the <br />material was hauled to the site in Delta where the main offices and <br />concrete batch plant facilities are located. <br />There are a three reasons this was done: <br />1) 'Iwo of the gravel pits operated by Delta. at that time <br />were located in area that were inundated by flood waters <br />yearly •and it was necessary to process off site for <br />._ safety i-eaaons. . <br />
