Pit # 1, M-77-020 and Pit # 3, M-77-022 7985 VANCE DRIVE, SUITE 205A ARVADA, COLORADO 80003 303.423-7297 FEB z 5 1894 It has come to my attention that there is a discussion taking place between the Division of Minerals and Geolo~fy staff and the Gelta Sarrd and Gravel Co. concerning the approval of these permits. In particular, the problems seems to be whether the processing areas near~Pit #3 in`Paiona anci the processing site in Delta (Delta plants were'in use prior to and for the sole purpose of processing material from all the Delta pits in the market area. I was the consultant that prepared the applications and represented Delta Sand and Gravel in March, 1977 when they came before the MLRB. I do not recall if this was specifically discussed at that time, but know that we stated in both permit applications that materials mined from these pits would be processed offsite. There were three pits operated by Delta Sand an3 Gravel when the Lat•~ went into affect and the Delta Plant and the Paiona site existed prior to the law also. The fact that processing has always taken place off the mine sites was reconfirmed for Pit #1 on page 7 of the 1980 Conversion application that should be in your files. While the exact location of the processing site was not spelled out in the applications, the material was hauled to the site in Delta where the main offices and concrete batch plant facilities are located. There are a three reasons this was done: 1) 'Iwo of the gravel pits operated by Delta. at that time were located in area that were inundated by flood waters yearly •and it was necessary to process off site for ._ safety i-eaaons. .
