On April 13, 1984, you, as representative of.the,Colorado..Department of Health,
Air Pollution Control Division, performed a final approval inspection of the Terror
Creek Company Load-out Facility under Emission Permit 82DL343F. At that Time Terror
Creek Company was found not to be in compliance with Permit limitations; specifically,
in violation of the stipulation requiring finished stockpiles not to exceed 6,000
tons aggregate with a maximum of 2,000 tons fines at any time.;: Terror Creek Company
was given 120 days in which to meet the terms and ;conditions of the Permit and cure
the violation. '

I am pleased to report the following stockpile status at the Load-out facility
as of June 1, 1984: '
Raw Goal Stockpile '4,01,0 tons:
Finished Coal Stockpile -Sized i 290 tons
Finished Coal Stockpile -Fines' ;1,090 tons
Total Stockpile 5,390 tons
The above listed stockpile tonnage is, of course, well within the limitations as
rewired in Emission Permit 82DL343F. Because of newly secured contracts for the ship-
ment of coal from the facility, Terror Creek Company anticipates little difficulty
remaining in compliance in the future.
On a related matter, during your inspection of April 13, 1984, you expressed some
concern about dust emmitting from the discharge of the coal crusher. Terror Creek
Company installed a spray bar at the discharge, as per your recommendation, which has
resulted in a substantial reduction of dust at this point.
