Carson <br />Route 1 Box 177 <br />Cedaredge, CO 81413 <br />Colorado Mined Land Reclamation Board <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />RE: OBJECTION TO OPERATION OF COALBY MINING COMPANY <br />Gentlemen: <br />I wish to register an objection to any further operation of Coalby Mining Co., <br />Red Canon Mine or aqy other name that may be chosen, for the sloppy operation <br />located at T 13$'R 95 6 PM Sec. 12 S.W.~ of S. W. W~, by Joe L. Belden, Richard <br />Belden, Belden and Sone, Belden Enterprises or aqy other name that may be chosen. <br />I've the following reasons: (1~ No effort ie being made now or ever has been <br />made to retain coal slack over burden and stoker oil on the mine property during <br />run off periods. (2~ No reclamation work of arty kind has ever been done at the <br />mine, this includes the open pit operation of several years ago and the more re- <br />cent abandoned entrance. <br />EXPLANATION: I farmed 93 acres, 66 acres of which was irrigated crop land using <br />1 c.f.s. of 1887 decree from 1958 to 1970, during the time the Red Canon mine <br />was operated by Iynden Fogg, I had no trouble. Sometime prior to fall of 1970 the <br />mine was purchased by Belden & Sona. The strip operation along with dumping <br />slack and stoker oil in the water shed and racoursing run off water so that it <br />dumped out of a culvert directly into the slack pile, filled all my leveling <br />ponds and ditches, during the winter it flooded uncontrolled over my Fields, <br />stoker oil killing an estimated 80,E of the plant life on 40 acres, this was esti- <br />mated by the Soil Conservation Service. The farm had been, from 1957 to 1970 in <br />the soil conservation district and under good soil conservation practices. <br />All this damage was done by the Belden's while they had full knowledge of what <br />they were doing. <br />I enlisted several tax supported agencies and the Belden's made many promises to <br />them only to break the. I processed my damages through civil court and stayed <br />a judgement and this has done no good either. <br />In summary; The once good farm land is still waste land and the Red Canon Mine <br />continues to operate in the same sloppy manner, ignoring all recommendations of <br />E.P.A., Water Quality Control, Department of Natural Resources and the courts of <br />our land. <br />Encl. <br />Sincere y <br />~'/ ~~0 <br />n <br />
