Road 63.9
Trinidad, CO 81082
Re: Vent Shaft Closure -Golden Eagle Mine -Permit No. C-81-013
Dear Mr. Thompson:
This letter is written as afollow-up to out previous letter of July 2, 2003, and subsequent
conversations held between the Division of Minerals and Geology (DMG) and
representatives for Basin Resources, Inc. (Basin), pertaining to the pending vent shaft
closure issue at the Golden Eagle Mine. We will also address issues contained in the
letter from Davis Graham and Stubbs dated September 16, 2003. Significant potential
compliance issues addressed in the DMG letter dated July 2, 2003 remain unresolved at
this time, and it is imperative that we move towazds resolution in a timely manner.
Specific to the September 16, 2003 letter, and subsequent to conversations with Basin
representatives, it is our understanding the Mr. Tat(lm is no longer alleging that Basin
may not have access the vent shaft site. Regazdless, all permittees must maintain access
to mining and reclamation sites to perform all required duties pursuant to the Coal Rules
and Law. As discussed with Basin representatives, if Basin no longer has the legal right
to enter the vent shaft site to perform such required dufies, then Basin may no longer be
in compliance with the Permit No. C-81-013 and the applicable Rules and Law. Please
advise the DMG as to Basin's position in this matter.
Also, specific to the September 16, 20031etter, and as discussed with Basin
representatives, the bonding for the vent shaft site may or may not be adequate. If
additional work is required to properly seal the shaft, then additional bond maybe
required.
Office of Office of Colorado
Mined Land Reclamation Active and Inactive Mines Geological Survey
