Eilts <br />Coal View Ghost Ranch <br />565 Sandrock Drive <br />Craig, Colorado 81625 <br />RE: Letter Received October 15, 1991 Regarding Meadows No. 1 Mine, (C-81-029) <br />Dear Mr. Eilts: <br />We would like to take this opportunity to point out possible options for <br />you regarding the disposition of Sun Coal Company's Meadows Number 1 Mine. <br />Your letter of October 15, 1991 stated: "Our solution is to allow the <br />Colorado Mined Land Reclamation Division and Colorado Mined Land Reclamation <br />Board to withdraw from (the Eilt's) ranch. Sun Coal would perform certain <br />work in the pit area and pay (Eilts) $200,000.00 to correct areas not <br />reclaimed. Sun Coal would be released from all bonds and responsibility. <br />(Eilts) would assume all responsibility for our ranch with no bonds or <br />inspections. In short no inspections etc. we do as we please with our ranch. <br />If you wish to assume reclamation liability for the permit area, you could <br />file for a succession of operator in conjunction with Sun Coal Company. The <br />Division has no authority to participate in arranging such agreements. If you <br />became the permittee, you would assume all responsibilities and liabilities <br />associated with the permit. The Colorado Surface Coal Mining Reclamation <br />Act and Regulations specify a minimum liability period of 10 years following <br />revegetation. This period will end in 1994 for the Meadows No. 1 Mine, at <br />the earliest. Bond can only be released at that time if the approved <br />revegetation success criteria and other requirements of Rule 3.03 have <br />been met. <br />You should also be aware that, regardless of who the permittee is, the <br />Division is required to conduct inspections of the mine until all bond and <br />liability has been released.
