Sun Coal would perform certain
work in the pit area and pay (Eilts) $200,000.00 to correct areas not
reclaimed. Sun Coal would be released from all bonds and responsibility.
(Eilts) would assume all responsibility for our ranch with no bonds or
inspections. In short no inspections etc. we do as we please with our ranch.
If you wish to assume reclamation liability for the permit area, you could
file for a succession of operator in conjunction with Sun Coal Company. The
Division has no authority to participate in arranging such agreements. If you
became the permittee, you would assume all responsibilities and liabilities
associated with the permit. The Colorado Surface Coal Mining Reclamation
Act and Regulations specify a minimum liability period of 10 years following
revegetation. This period will end in 1994 for the Meadows No. 1 Mine, at
the earliest. Bond can only be released at that time if the approved
revegetation success criteria and other requirements of Rule 3.03 have
been met.
You should also be aware that, regardless of who the permittee is, the
Division is required to conduct inspections of the mine until all bond and
liability has been released. Again, this will occur in 1994 or when
revegetation success criteria have been met.
Please contact me if you have any questions.
Sincerely,
~~~~
Carl B.
