Welt; <br />Previously we discussed the method Mountain Coal Company (MCC) should follow when <br />submitting revisions to the permit. The method currently in place is described <br />in the Application Form for a Revision to a Coal Mining and Reclamation Permit. <br />For federal mines, a copy of the revision application must be submitted to all <br />agencies on the federal mailing list at the same time the application is <br />submitted to the Division. The Division must receive proof of distribution. <br />Then copies of any pages modified during the review process moat be distributed <br />in the same manner, supplying the Division with proof of distribution. You <br />expressed a desire to send revisions to the agencies on the federal mailing list <br />upon receiving approval of the revision from the Division to limit the amount of <br />information sent to the agencies, which may or may not be approved. <br />The Division would accept this method of distributing revisions to the permit to <br />other agencies. However, if the revision requires the Office of Surface Hining's <br />(DSM) review (i.e. - permit revisions), then the application should be submitted <br />to the agencies at the same time it is submitted to the Division. Any revised <br />pages which are modified during the process should also be sent to OSM. If the <br />application only requires Division review, we recommend following revision <br />approval, MCC draft a letter to OSM referencing the revision and include the <br />approved revised pages, maps, and/or exhibits. The letter should be copied to <br />the Division and the other agencies on the list. <br />The Division will accept the courtesy copy list as sufficient proof of <br />distribution. The Division recommends that MCC send the revised pages certified <br />mail and retain the receipts in the file in the event there ie ever a question. <br />I have enclosed a copy of the federal mailing list for the West Elk Mine.
