Division Dheaor
P.O. Box 17304
Boulder, CO 80308-0304
Re: Permit Adequacy Information Submitted May 2, 1995, Gold Hill Mill,
File No. M-94-117
Dear Mr. Hartley:
The Division has reviewed your adequacy responses to our March 27, 1995
list of concerns and issues with the Gold Hill Mill permit application.
There are a number of clarifications required, and certain concerns to be
addressed before the Division can approve the application. Please provide
responses to the following list of issues prior June 1, 1995 in order to
facilitate a June 14, 1995 permit issuance date.
1. In our meeting on May 16, 1995, it was indicated that the exact
permit boundaries to be proposed have not yet been mapped on the basis of
your site survey. As you know, all surface disturbances related to the
mill operation will have to be included on a map, including the road
between the mill and the tailing impoundment, all proposed borrow areas,
and the eventual footprint for the expanded tailing facility. The map
must be prepared in accordance with the general requirements of Rule
6.2.1(2). An accurate permit area acreage must be provided on a revised
application form. As a point of clarification, the road between the mill
and the tailings is a pre-operational feature, and there is no problem
with the road remaining when operations are concluded, as long as it is
in a stable condition, but this is not a Forest Service road.
2. No land ownership map was included in your May 2, 1995 submittal.
Please provide a land ownership map as requested in item no. 2 of the
Division's March 27, 1995 letter.
3. A copy of the milling agreement between COM, Inc. and Mi Vida
Enterprises will be required to establish legal right to enter those
portions of the proposed permit area that are not owned outright by COM,
Inc. A copy of the milling agreement was not included in the May 2, 1995
submittal to the Division.
4. If COM, Inc. proposes to mine on the Oscar or the Good Enough
