Barry: <br />I want to express my appreciation for the diligence and control exhibited by <br />you and your staff in the joint review of the above referenced application/ <br />mine plan with the Office of Surface t^ining. I would also applaud your de- <br />partment's efforts to expedite, to the extent possible within the spirit of <br />rules and regulations, the FicClane Canyon Permit Application in the face of <br />adverse coordinating conditions between the state and federal agencies. <br />I am at least partially aware of the difficulties that you face in preparing <br />rules and regulations required by the Act of 1977, the efforts aimed at <br />finalizing a cooperative agreement, coordination of mining and permitting <br />activities with the Office of Surface I•iining and the review of numerous other <br />Colorado mining applications. In light of the above, it amazes me that your <br />staff has managed to maintain an air of professionalism and cooperation with <br />the operators that can only serve our joint interests. <br />I only hope that the cooperation, fairness, concern and open-minded approach <br />of you and your staff will not be totally eliminated by new arrangements <br />and/or joint efforts with the Office of Surface hlining. <br />I have instructed Bill Bosworth (our Director of Environmental Affairs) to <br />maintain the line of communication you have left open to us. If you have <br />any questions regarding the McClane Canyon application or a need for addi- <br />tional information, please contact us at your convenience. <br />
