• iii iiiiiiiiniu iii <br />2.06.10 <br />The applicant concurs that the loadout facility should be <br />covered in this application and that the performance standards of <br />Rule 4.28 does apply. <br />The applicant has addressed this in the submitted application <br />on page V-18 of Section 5.3.2.9 of the application as well as on <br />page VI-5 Section 6.3 of the application. The physical layout has <br />been shown Map V-3. <br />Following telephone conversations with Mr. Mike Savage, <br />Mr. Ben Quinn was informed that an approved sediment control plan <br />has already been submitted for this loadout facility. <br />An Air Pollution permit application has been submitted <br />to the Air Pollution Control Division of the Colorado Department <br />of Health. See the Adequacy Review Response, paragraph 2.05.6 <br />including copies of the permit application. <br />As the area is in an industrial area a copy of the lease <br />agreement and stipulations as to the requirements for vacating <br />the property are attached in the application, Section III. We <br />request that these requirements be allowed to be made. The <br />applicant will grade and leave the area in as "good as or better <br />than" condition than it was prior to Trinidad Basin Mining's lease <br />with the railroad. <br />J <br />~-ayA <br />
